New Jersey Child Support Attorneys
To a large degree New Jersey child support laws are formulistic. In almost all cases, the non-custodial parent is required to pay the primary custodial parent child support. New Jersey courts employ three important principals when it comes to child support cases:
- Child support is a continuous duty of both parents
- Children are entitled to share in the current income of both parents, and
- Children should not be the economic victims of divorce or out-of-wedlock birth.
Therefore, the courts apply the New Jersey child support guidelines that bases child support payments on net combined parental incomes, (up to a threshold of $150,800) and the number of nights spent with the non-custodial parent. Our child support attorneys have significant experience working with child support guidelines as well as negotiating and litigating child support payments when a parent’s income is above the $150,800 threshold.
New Jersey Alimony Lawyers
Unlike child support, there are no guidelines in New Jersey for alimony. Spousal support payments are based on a wide range of considerations including the lifestyle of the couple, length of the marriage, stage of life, income, children, and earning capacity. Our attorneys have significant experience handling rehabilitative limited duration and permanent alimony payments. While we strive to negotiate alimony payments when necessary, we have had successfully resolved alimony issues through litigation.
